Seeds of misfortune

Farmers’ bodies are concerned that the proposed draft Seeds Bill 2019 and Pesticide Management Bill 2019 could weaken farmers’ rights and increase corporate control over seed, as the definition of “farmer” has been tweaked to include traders and corporations as farmers. The original definition of farmer excluded any individual, company, trader or dealer who engages in procurement and sale on commercial basis (non-farmers); Bharatiya Krishak Samaj president Krishan Bir Chaudhary insists this should be retained.

 

The draft states, “Farmer means any person who owns cultivable land or any other category of farmers who are doing the agricultural work as may be notified by the Central / State Governments”. This identifies “farmer” as anyone owning cultivable land under clause 11, which makes all corporations who own land eligible to be classified as “farmer”, while the new exemptions of Clause 47 make multinationals exempt from any regulation under the Seed Law.

 

The draft Seed Bill introduces new commercial definitions of seed which facilitate easy market access to multinational corporations, rather than conserve our rich biodiversity and guarantee farmers the freedom to save and exchange seeds they have evolved, and ensure availability of high quality, reliable, affordable, and ecologically adapted seed for their ecosystem and agroclimatic zone.

 

The Bill introduces unscientific definitions like “national seed variety” and “state seed variety” in Clauses 17 (“national seed varieties” means those varieties which are cultivated in more than one State) and 31 (“State seed varieties” mean those varieties which are cultivated in one State only).

 

Seed is the expression of diversity of traits and diversity of agroclimatic zones where seed varieties are bred by farmers and to which they are adapted. To describe seeds, not according to traits and agroclimatic zones, but as “national seed” if grown in more than one state and “state seed” if grown in one state has no scientific basis. This is a commercial description, to facilitate the marketing and spread of unreliable and costly seeds from MNCs.

 

Under the 1966 Seed Act, new Seeds were evaluated in 22 agroclimatic zones to ensure farmers get quality seed. Strangely, the 2019 Seed Bill makes evaluation optional: “The Committee may, for conducting trials to assess the performance, accredit centres of the Indian Council of Agricultural Research, State Agricultural Universities and such other organizations fulfilling the eligibility requirements as may be prescribed, to conduct trials to evaluate the performance of any kind or variety of seeds”.

 

The Seed Bill should ensure compensation to farmers in case of seed failure, under the Bill. Instead, it leaves farmers to seek compensation for seed failure under the Consumer Act. Liability clauses are meaningless if there is no liability for seed failure. The Consumer Protection Act, 1986, stated that the producer, distributor or vendor of seed of registered kind or variety “shall disclose the expected performance of such kind or variety to the farmer under given conditions”, and if such seed failed to perform as expected, the farmer could claim compensation from the producer, dealer, distributor or vendor.

 

The 2019 Draft Bill is a Compulsory Seed Certification Bill under which Seed producers and seed processing units must be registered [247, 22(1) and (2)]. Article 12 states that farmers “shall not be required to register the farmers’ varieties of seeds in the said register”, but the deletion of farmers rights in Exemption clause 47 dilutes farmers rights.

 

Significantly, “transgenic seeds” are introduced. A new category of “synthetic seeds” enters the definition of “seed” in article 24.  Section 44 opens the door for introduction of transgenic varieties cleared by the Genetic Engineering Appraisal Committee (GEAC). Under “Special provision for registration of transgenic varieties”, it states, “Notwithstanding anything contained in section 14, no seed of any transgenic variety shall be registered unless the applicant has obtained a clearance in respect of the same as required by or under the provisions of the Environment (Protection) Act, 1986: (29 of 1986)”.

 

But the biosafety regulatory agency is a failure. It approved Bt Cotton which is failing; it approved Bt Brinjal which the Minister overruled; it approved GM Mustard even though it has lower yields than indigenous public varieties and is tolerant to the prohibited herbicide, glufosinate. Only a case in the Supreme Court has prevented its commercialisation. Now, the 2019 Seed Bill could allow commercialisation of Bt Brinjal and herbicide-tolerant Mustard.

 

The Central Seed Committee under the 1966 Act included one person to be nominated by each State Government. The 2019 Seed Bill has changed this provision to five representatives chosen by the Centre on rotational basis. Meanwhile, the Seeds Division, Dept. of Agriculture, has asked sellers for Expression of Interest (EOI) for bar coding seed packets for a ‘national seed traceability system’. This must surely wait until Parliament passes the Bill.


Coming to the Pesticide Management Bill (PMB), it must provide for compulsory registration of Technical Grade Pesticides in India, prior to granting registrations for Imports or Indigenous Manufacture of Pesticides Formulations, which is the prevailing practice in major agricultural nations such as the US, Europe, Brazil, China, Australia, Argentina.

 

The PMB should not include Data Protection for Agrochemicals / Pesticides as such provisions will effectively extend the monopoly enjoyed by multinational corporations, which already have 20-year Patent Protection under WTO (effective in India from 2005). Additional Data Protection would mean ever-greening of Patents. Data Exclusivity in Agrochemicals sector will delay entry of Generics and make agrochemicals / pesticides unaffordable for Indian farmers. Moreover, the PMB lacks a “Pesticide Schedule”. The Insecticide Schedule is an integral part of Insecticide Act, 1968 and helps applicants and regulators to decide if registration is required or not.

 

The PMB’s over regulation of exports will adversely affect exports of pesticides, which can earn foreign exchange and boost the indigenous agrochemicals industry. Export Orders for Pesticide Formulations are time-bound depending upon the agriculture season in different countries, and timely delivery is critical or customers will go elsewhere. All importing countries have their own regulations and registration requirements for imports, which each exporter has to fulfill. Hence, imposing unnecessary data requirements and raising unqualified deficiencies for export-oriented products will only add to costs and delays. Data available in public domain should be accepted by the registration authority, as export orders are country specific. The Ministry of Agriculture would do well to resolve these issues before proceeding with these legislations.

Israel and india are birds of feather as they have one thing in common, they both are occupiers of Muslim lands and are know for the genocide of the local populous.
Actually the fact of the matter is that Israelis have been exchanging "notes and expertise" with india on how to brutally crush the "intifada" in both in Occupied Jammu Kashmir as well as in Occupied Palestine and their are proofs that what is happening in Jammu and Kashmir at the hands of the occupying indian army and the so called security forces are the same practices evolved by the Israelis.
Another thing that is important to note here is that the total population of Israel is way less than the total population of Mumbai's slums alone but still they (Israelis) have more brains than the over 1.2 billion Indians ..... I wonder why?
India is becoming a cash cow for the west and for anyone with high tech capabilities as india still has to produce anything worthwhile in armaments .... no wonder modi loves to give bear hugs where ever he sees a little benefit (a typical gujju mentality)!

unfortunately Modi has become the new arm of the west to exploit and dominate the countries which india now considers its back garden. The independence and the natural leadership that India has been sold to becoming the regional power of the western compiled world. One must never forget the part played by Isreal in destabilising Sri Lanka by selling arms to both sides and at the same time training the Tigers and Sri Lankan Army and calling them monkeys. Refer Way of Deception. This new relation ship will only destabilise South Asia as more and more countries will distrust India.

Thankyou Sandhyaji for the details concerning the arrival of Jews in India. They settled in the country and contributed to its welfare, very much like the Parsis.

Unfortunately, this cannot be said of certain other communities.
The partition of our ancient land speaks to that tragedy.

I do wish more Indians would research the statements made by the creators of Israel, and note the behavior of the Stern Gang, and the killing of 10,000 Palestinians; not to mention the occupation and theft of the West Bank.

Then take into account the killing of 400 children on the Gaza, and the illegal executions of the aid workers in international workers.

You do not have to look far to realise that Israelis are without honour and owe allegience only to themselves.

Their claims to have contributed to India down through the ages are pure nonsense... the Israselis are an Ashenazim race, descended from the Khazar Empire, whose ruler adopted Jewish religion by decree. There is no Hebrew DNA in Askenazim, and they are Khazar/German or Khazar/Russian, depending upon which direction they fled when the Mongols invaded their homeland.

Thus, Yiddish is a combination of German and Khazari and is in no way related to ancient Hebrew. Ironically, Constantine pulled the same stunt as the Khazar Emperor and created Christianity around 1653 years ago, for the same reasons... Christ derived from the Indian Krishna, and Jesus from the German god Gesu (which later became Jesu).

It kinda looks like Indians are as gullible as Christians.

Personally, I prefer Krishna to the Christian bloke.

Anyway, if Indian students of geopolitics are not aware that Israel is behind all the Middle East wars, and that the overall objective is to spread internecine war across Asia, leaving Israel the undisputed boss, then you will pay a tragic price for your own gullibility and weakness for flattery.

Israels and jews are root cause of all terrorist attacks in the world.. The israeli jews are occupiers of the arba palestine land, and the Hindu Right wing are ignoring these harsh truths, because of their past brutal muslim invasions. They mistakenly associate jews as similar victims of islamic invasion, but in reality the two case are different.

Israel is an illegimate entity in the land of arabs, and hindu should not support israel in their enmity to muslims. the arabs and palestines are the natives of arabia and palestine.

Dear Editor,

Some of the anti Israeli comments are actually expressions of antisemitism.

The Hebrews were there long before the arabisation of peoples in that region. The Palestinians are descendants of this late phenomenon arabisation.

However, India has always endorsed the Palestinian cause. That does not mean that India should not have a bilateral relationship with Israel as do Muslim countries like Saudi Arabia, Egypt, Turkey.

Jews were the dominating race a long time before the Arabs emulated the violent ways of Mongol ruler Jenghis Khan and drove the Jews from their homeland just as they drove the Parsis from their. The Muslims all over the world have poured tons of crocodile tears for Palestinians yet they have brutally murdered masses and denied them food and water.

Muslims feign injustice yet their own behaviour in every part of the world and the Terrorism hardly is a sbject to be heard from Muslims. Muslims of India proudly adopted the title which is Mongolian in origin for a tribal leader perhaps due to his brutality.

The Co-operation between Israel and India can have great results for both sides.Indeed It defies belief that an oasis of peace and tranquility exists in burning sea of blood where one Muslimis killing other in the name of God(?).

We should not make too much of the official noise around the visit of the Indian Prime Minister to Israel. Technical experts assure me that most cooperation projects have been ongoing for several years and not many new decisions or agreements have been made on this occasion. Obviously the scope for cooperation with a small country like Israel is limited although it is interesting in a few specific areas. Israel is overwhelmingly dependent on US and European technical and financial transfers and its track record in environmental and resource management is mixed. It overuses water and puts too heavy an urban burden on a naturally poor and semi-arid land,.It holds no miracle solution for any of India's problems. However the global Jewish diaspora is very influential and it makes sense for India to remain in good terms with it even though conservative Jews, like radical Muslims, do not accept that there can be equal relations with "gentile" or idolatrous peoples.
